Artists and Copyrights

New York Memories

So- I have a question about artists and how copyrights affect our art.  I am VERY careful about not copying art of other artists, and paint my paintings from photos I take myself.  I would hate it if anyone copied my work, and would not do that to another artist EVER.  Well- I have some NYC subway tokens and thought they would make fun charms for my jewelry in my Etsy shop.  I looked around the internet - I saw many jewelry items using subway tokens, so I thought it was okay to use them.  After all, I am not trying to sell them to use on my subway- or saying that I designed them myself.  I am in no way claiming that I am affiliated with the MTA- or selling them as a token, simply as a piece of art.  My question is- how can recycling  a subway token hurt the MTA in any way?  I think I am free to sell these out-of-use tokens on ebay or at an antique store, so why not as a charm?
This necklace has been listed on Etsy for some time and out of the blue, I find out that it infringes on a trademark and I cannot sell it.  My main problem isn't that I cannot sell the necklace, but that MANY items like mine are available with a simple Google search.  Maybe I should have one of these other artists sell my item for me since they are free to sell them.

New Watercolor : Childhood Skyline Memories

Childhood Skyline Memories
9X12 Watercolor

We moved to Long Island in 1993, when both of our boys were  very young.  The first thing we did, was go to New York City- and take the trip out to the Statue of Liberty.  No matter how many times you see it, the Statue is an awesome sight!
This watercolor is painted from a photo I took that day of the boys looking back at the New York skyline from Liberty Island.  Looking across New York Harbor, you see Ellis Island and the fantastic skyline of New York City. No matter how many photos I have taken since (and there are thousands) this is one of my very favorites.  One reason is that it reminds me of three things-

1. our big move from California to New York
2.  how much fun raising 2 little boys can be
3. how glad I am that we got to see the skyline as it was-
including the Twin Towers

World Trade Center Memory

This is a page from one of my scrapbooks- made many years ago. The photo was originally one of my favorite photos of my boys taken about 2 weeks after we moved to New York in 1993. It is still one of my favorite photos, but not simply a happy memory any longer. My last photo of the World Trade Center was taken during a weekend stay in NYC for my birthday- August 27, 2001. We stayed at the Millenium Hilton on Church Street in Downtown Manhattan. I took a photo of the Statue of Liberty from our hotel window and the Twin Towers were directly in the line of my shot. I didn't know at the time that I wouldn't be taking any more of those photos and taking those buildings for granted.
